Brazil's chief justice has ordered that Sean Goldman be handed over to his father, David, who has been fighting for custody since his now-dead wife fled the United States with his son in 2004.
Chief Justice Gilmar Mendes lifted a stay on a lower court's order last week that Sean be returned to his father, who lives in Tinton Falls, N.J.
The boy's Brazilian grandparents and step-father might possibly appeal, but lawyers said their chances of success appear slight, the Associated Press said.
Sean, now 9, was taken to Brazil by his mother, Bruna Bianchi, who divorced Goldman and remarried. In 2008 she died giving birth to a daughter.
The case has affected diplomatic ties between Brazil and the U.S., and has been discussed by President Barack Obama and Brazilian President Luiz Inacio Lula da Silva. Last week, a U.S. senator reacted to the case by blocking renewal of a $2.75 billion trade deal that would lift U.S. tariffs on some Brazilian goods.
